By using Hauora Medical Travel’s (“we,” “our,” “us”) services, you agree to the following Terms and Conditions. Please read these carefully before engaging our services.
1. Our Role
* We are a New Zealand–based medical tourism facilitator.
* We **do not provide medical advice** or treatment. Our role is to assist you in accessing healthcare providers in Malaysia, arranging travel, accommodation, and related logistics.
* Medical decisions, diagnoses, and treatment are the sole responsibility of the independent healthcare professionals you choose to engage.
2. Medical Disclaimer
* We are not liable for the quality of medical advice, care, or outcomes provided by healthcare providers overseas.
* We do not guarantee specific treatment results or recovery outcomes.
* All medical treatments carry risks. You are responsible for discussing these risks directly with your chosen healthcare provider.
3. Client Responsibilities
By engaging our services, you agree to:
* Provide complete and accurate personal, health, and travel information.
* Obtain all necessary travel documents (passport, visas, insurance).
* Comply with any medical advice or post-treatment requirements given by your chosen provider.
* Arrange appropriate **travel insurance and medical insurance**, including coverage for complications.
4. Payments and Fees
* Our facilitation fees must be paid in full before arrangements are confirmed.
* Hospital, travel, accommodation, and other third-party provider fees are your responsibility and must be paid directly to the provider unless otherwise agreed.
* Fees may vary depending on treatment type, provider, or travel season.
5. Cancellations and Refunds
* Once arrangements are confirmed, our service fees may be **non-refundable**.
* Refunds for hospital, airline, or accommodation services are subject to the policies of those providers.
* We are not responsible for any loss caused by travel delays, cancellations, or force majeure events (including pandemics, natural disasters, or government restrictions).
6. Liability and Limitations
* We are not responsible for the actions or negligence of third-party healthcare providers, travel companies, or other service providers.
* To the maximum extent permitted by law, our liability is limited to the total amount you have paid to us for facilitation services.
* Nothing in these Terms excludes liability where it cannot be excluded under New Zealand law, including liability under the **Consumer Guarantees Act 1993** and the **Fair Trading Act 1986**.
7. Privacy and Confidentiality
* We handle your personal and health information in accordance with the **Privacy Act 2020** and the **Health Information Privacy Code 2020**.

8. Governing Law
* These Terms and Conditions are governed by the laws of New Zealand.
* Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
